1. Our Commercial Policy
1.1 The Seller offers products for sale on www.capuzzimoda.com and conducts e-commerce activities exclusively with its final users who are "consumers."
1.2 When we refer to "consumer," we mean any individual who acts on www.capuzzimoda.com for purposes not related to their commercial, business, or professional activities they may carry out. 1.5 The General Sales Conditions do not regulate the supply of services or the sale of products by third parties who are present on www.capuzzimoda.com through links, banners, or other hypertext links. We recommend that before placing orders and purchasing products or services from parties other than the Seller, you verify their sales conditions, as the Seller is not responsible for the provision of services by third parties or the conclusion of e-commerce transactions between users of www.capuzzimoda.com and third parties.
1.6 www.capuzzimoda.com reserves the right to reject orders placed on its website if it deems that there are no adequate contractual grounds in line with the Seller's policies.

2. How to Complete the Contract with DLF srl
2.1 To complete the purchase contract of one or more products on www.capuzzimoda.com, you must fill out the order form in electronic format and submit it to the Seller electronically, following the relevant instructions. The sales contract will be stored in our archive. After completing the purchase contract for one or more products by submitting the order form, you will receive a confirmation email summarizing the operation and providing a summary of the essential characteristics of each ordered product, including the respective price (including all applicable taxes or duties), the payment methods used to purchase each product, the delivery methods for the purchased products, shipping and delivery costs, and the contact and geographic address of the Seller.
2.2 In the order form, which will be displayed immediately before finalizing the purchase contract, we will provide summary information about the essential characteristics of each ordered product, the price (including all applicable taxes or duties), and the shipping costs. The contract is concluded when the Seller receives your order form electronically, after verifying the correctness of the data related to your order. The sales contract will be stored in our archive.
2.3 Product Availability. Product availability refers to the actual availability at the time the buyer places the order. This availability should, however, be considered purely indicative, as products may be sold to other customers before the order is confirmed due to their simultaneous presence on other online sales channels and in physical stores. Even after the order confirmation email has been sent, partial or total unavailability of the goods may occur. In this case, the order will be automatically adjusted by removing the unavailable product, and the buyer will be immediately informed via email. If the buyer requests the cancellation of the order, terminating the contract, www.capuzzimoda.com will refund the amount paid within 14 days from the date of receipt of the goods, following a communication of withdrawal. Orders will be processed during the following hours: Monday to Friday, during the time slots visible on the website www.capuzzimoda.com.
2.4 Invoicing. The invoice can only be requested at the time of order confirmation by filling out the dedicated forms available immediately after payment. Invoice requests cannot be accepted after order confirmation or in the following days.
2.5 Severability Clause. If any clause of these General Sales Conditions is found to be invalid for any reason, this will not affect the validity or enforceability of the remaining provisions contained in these General Sales Conditions.

3. Warranties and Pricing Information for Products
3.1 On www.capuzzimoda.com, we exclusively offer luxury and top-quality brand products for sale. These products are directly purchased by the Seller from manufacturers and authorized boutiques selling the brands featured on www.capuzzimoda.com, carefully selected for their strict quality controls.
3.2 The Seller does not sell used, irregular, or inferior-quality products compared to the corresponding standards offered on the market.
3.3 The essential characteristics of the products are presented on www.capuzzimoda.com within each product page. However, the images and colors of the products offered for sale on www.capuzzimoda.com may not correspond to the actual ones due to the browser and monitor used.
3.4 Product prices may be subject to updates. Please verify the final sale price before submitting the corresponding order form.
3.5 Purchase requests from countries not included in the SHIPPING section will not be accepted by the Seller.
3.6 All products are provided with an identification tag secured with a tamper-proof seal. Please do not remove the tag or its seal from the purchased products, as they are an integral part of the item. If you exercise your right of withdrawal, the Seller may refuse the return or not fully refund the amounts paid for the purchase of products that are missing their identification tag, have been altered in their essential and qualitative characteristics, or have been damaged. Each item must be returned in its original condition, unworn, with all original tags and labels attached, and must include all original packaging and accessories received with the order. Footwear and accessories must be returned in their original box, which is considered an integral part of the product and must not be damaged or used as external packaging for shipping.
3.7 Products sold on www.capuzzimoda.com are protected by the legal warranty of conformity as per Articles 128 et seq. of the Consumer Code.
3.8 Consumer rights regarding warranty on product conformity. The Consumer Code (D. Lgs. n. 206/2005) Articles 128-135 stipulates the obligation to ensure that the purchased goods conform to the characteristics and quality offered. The seller is therefore responsible for any conformity defects that exist at the time of delivery for all products sold in their stores.
3.9 A conformity defect exists when the product:
- does not match the description or lacks the qualities presented by the seller.
- has defects that limit its usual performance (e.g., poorly sewn buttons, defective seams). In the event that the Customer receives a defective item or if there is an error attributable to the seller in the fulfillment of the order, the return shipping costs will be covered by the seller.However, the Customer is required to provide photographic evidence of the defect or error, to be sent to Customer Service. The return will only be authorized after verification and approval by the seller.
3.10 The Legal Warranty exclusively protects the "consumer," i.e., the individual who, having purchased a product, acts for purposes unrelated to their business, commercial, craft, or professional activities, and therefore does not apply to products purchased with an invoice and VAT number by professionals and businesses.
3.11 The products must not have been used, worn, washed, or damaged;
the identification tag must still be attached to the products with the tamper-proof seal. In the case of a conformity defect reported within the required timeframe, the consumer is entitled to have the conformity of the product restored by the seller, at no cost, either by repair or replacement, or by a reasonable reduction in price or contract termination.
In particular, the consumer is entitled:
- as a secondary remedy (if the first two remedies are impossible or excessively costly, or if not completed within a reasonable time, or previous repairs or replacements have caused significant inconvenience to the consumer), to request a price reduction or contract resolution.

5. Payments
5.1 To pay for the price of products and the related shipping and delivery costs, you can follow one of the payment methods indicated in the order form. In no case will you be charged costs exceeding those actually incurred by the Seller in relation to the payment method you selected.
5.2 The payment for the order can be made using the following methods: bank transfer, credit card, PayPal, and Scalapay.
5.3 3 If you buy with Scalapay, you receive your order immediately and pay in 3 installments. Please note that the installments will be assigned to Incremento SPV S.r.l., related parties, and their assignees, and you authorize this assignment.
5.4 In the case of payment by credit card, financial information (e.g., credit/debit card number or expiration date) will be sent, via encrypted protocol, to Banca Sella or other banks that provide the relevant remote payment services, without any third party being able to access it. These details will also never be used by the Seller except for completing the procedures related to your purchase and for issuing refunds in the event of returns, due to the exercise of your right of withdrawal, or if necessary to prevent or report fraud to law enforcement authorities on www.capuzzimoda.com. The price for the purchase of products and the shipping and delivery costs, as indicated in the order form, will be charged to your account at the time of payment confirmation.
5.5 Complete the order and pay securely and conveniently by making a bank transfer directly to our account. You will receive an email with all the necessary bank details to complete the transaction through your home banking. Please note that the transaction may take from 1 to 3 days, and the order will be processed once the payment is credited. If you choose to pay by bank transfer, you must send us a payment receipt within 48 hours to the email address: shop@capuzzimoda.com. The order will be processed once the credit has been received (typically within 1 to 3 days). After this period, if the payment has not been credited, the order will be considered canceled.
5.6 It is also possible to settle the order and proceed with pickup directly at the store.
5.7 This online store operates from the European Union, and all transactions are conducted in Euros (unless otherwise specified). If you pay in a different currency, the currency conversion will be based on the exchange rate on the day of the purchase. There are no additional fees for currency conversion.
6. Discount Codes
6.1 Discount codes are personalized codes that allow you to benefit from a discount on purchases made on www.capuzzimoda.com.
6.2 The discount code box is displayed on the first page of the purchase process: once you have added items to your Cart, enter your code in the discount code box and click "APPLY."
6.3 Limitations on the use of discount codes: A) The discount code with a value cannot be converted into cash in any way; B) It is not possible to use multiple discount codes in the same order; C) It is not valid for products that are already on promotion.

Please pay attention to what is reported in this section, as the VAT details included are an integral and essential part of these General Terms and Conditions of Sale and are therefore deemed to be fully known and accepted by you when submitting the order form.

8. Shipping and Delivery of Products
8.1 Please pay close attention to the information contained in this section, as it forms an integral and substantial part of these General Terms and Conditions of Sale and is therefore deemed to be fully known and accepted by you at the time the order form is submitted.
DLF s.r.l. ships to Italy, Vatican City, the Republic of San Marino, and the European Union.
Shipments are mainly carried out via BRT and DHL. In any case, DLF s.r.l. reserves the right to use other trusted couriers.

The recipient is responsible for any import taxes and customs duties imposed by the destination country. We are unable to determine in advance the exact amount payable for shipping, taxes, and duties; therefore, only the amount calculated at checkout should be considered valid.
8.2 Orders shipped to Italy, Vatican City, and the Republic of San Marino are prepared and delivered within 48–72 hours from the shipping date.
For EU and non-EU countries, delivery times range from 3 to 5 working days from the shipping date.
Orders received on Fridays after 12:00 p.m. and those placed on Saturdays and Sundays will be handed over to the carrier within 1–2 working days.
Please note that delivery times are purely indicative and, although usually respected, cannot be guaranteed as they are subject to events beyond our control and responsibility.
8.3 Courier deliveries are generally made between 9:00 a.m. and 6:00 p.m., Monday to Friday, at street level and without prior notice.
If the recipient is absent, the courier will send an email to certify the delivery attempt, including contact details to reschedule a second delivery.
If you do not contact the courier within one day of the second delivery attempt, the parcel will be returned to the sender.
8.4 At the time of shipment, you will receive a notification from us or directly from the courier containing the tracking number, which can be used to monitor the delivery status of your parcel.
You can track your shipment on the website of the designated courier.
Upon delivery, please check that the package/envelope is intact. Our packages/envelopes are sealed with our branded tape.
If you notice any damage, you must report it by adding a written and reasoned reservation of inspection (e.g. “damaged packaging” or “torn envelope”).
Only by completing this procedure will you be able to initiate a refund request.

9. Right of Withdrawal
9.1 Returns are at the customer’s expense. To exercise the right of withdrawal, the customer must access their personal account or enter the email address used at the time of purchase and select the option “Request Return”.
The returned goods must be shipped to the same address from which they were originally sent, namely Capuzzi Moda – Casoli headquarters.
Return shipping costs, any applicable customs duties, as well as responsibility for the goods until receipt is confirmed by DLF s.r.l., shall be entirely borne by the customer.
Should the return fail to reach its destination for any reason whatsoever, the full amount paid for the product shall not be refunded.
As an alternative to arranging the return independently, the customer may use the couriers partnered with DLF s.r.l. for the return of the goods. In this case, the shipping service cost is borne by the customer and is indicatively €7.00 for Italy and €25.00 for EU countries.
These amounts are indicative and may vary depending on the destination, weight, and conditions of the requested service.
If the customer chooses this return method, the shipping cost will be deducted directly from the refund amount.
In the event of an in-store return, the return is free of charge.
Each item must be returned intact, unused, with all original labels and tags attached, and complete with all original packaging and accessories received with the order.
Footwear and accessories must be returned in their original box, which is an integral part of the product and must not be damaged or used as external shipping packaging.
If the customer receives defective goods or if there are errors attributable to the seller in fulfilling the order, the return shipping costs will be borne by the seller.
In such cases, the customer must provide photographic documentation supporting the claim, to be sent to Customer Service.
The return will be authorized only after verification and approval by the seller.
9.2 You have the right to withdraw from the contract concluded with the Seller, without any penalty and without providing any reason, within fourteen (14) days from the date of receipt of the products purchased on www.capuzzimoda.com
In certain specific cases, duly indicated in the Right of Withdrawal section, it will be possible to exchange the selected item for another one.
9.3 To withdraw from the contract, you may use the Return Form available on the website.
9.4 Once the right of withdrawal has been exercised, you must return the products to the Seller by handing them over to the courier for shipment within fourteen (14) days from the date on which you communicated your decision to withdraw from the contract to the Seller.
9.5 The costs borne by you are those related to the return of the purchased products and any costs applied upon the return of the package, which will be deducted from the refund amount, unless the Seller has expressly exempted you from such costs at the time of purchase.
9.6 If, at the time of delivery of the products previously contracted with the Seller, the customer refuses delivery of the package without a valid reason promptly communicated to our customer service (shop@capuzzimoda.com), or fails to provide a complete and accurate shipping address, the customer shall not be entitled to a full refund of the amounts already paid to the Seller.
In such cases, the refund due will be reduced by an amount equal to the shipping costs (outbound delivery to the customer and return shipment to the Seller).
10. Refunds Times and Methods
10.1 After the returned products are received, the Seller will carry out the necessary checks to verify their compliance with the conditions and terms mentioned in paragraph 3. If the checks are successful, the Seller will send you an email confirmation of acceptance of the returned products. If the checks do not conclude positively, the Seller will inform you via email about the reduction in the value of the returned products. At the same time, the Seller will inform you of the amount that will be deducted from the sums you paid for the returned products. Alternatively, you will have the option to recover the products at your own expense, in the condition in which they were returned to the Seller.
10.2 Regardless of the payment method you used, the refund, whether full or partial, will be processed by the Seller as soon as possible and no later than fourteen (14) days from the date the Seller receives the returned goods, after verifying the correct execution of your right of withdrawal and the condition of the returned products.
10.3 The Seller will issue the refund using the same payment method you used for the purchase, unless you expressly agree with the Seller to use a different payment method, and provided you do not incur any additional costs as a result of the refund. If there is no match between the recipient of the products indicated in the order form and the person who made the payment, the refund will be issued to the person who made the payment.
10.4 The value date of the credit will be the same as the charge date; therefore, you will not incur any loss in terms of bank interest. If you choose to use a courier different from the one indicated by the Seller for the return, you will be responsible for the shipping costs, including VAT, and the responsibility for any loss or damage to the products.
